By accessing or using the xmpl website and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you should not use our website or services.

Services

xmpl provides web development services including website design and development, web application development, and mobile application development. The specific scope, deliverables, timeline, and pricing for each project are defined in a separate project proposal or agreement.

Project Agreements

Each project is governed by a separate project proposal that outlines the scope of work, deliverables, timeline, and payment terms. The project proposal, once accepted by both parties, becomes a binding agreement and supplements these Terms of Service.

Payment Terms

• A 50% deposit is required before work begins, unless otherwise specified in the project proposal.
• The remaining balance is due upon project completion and before final deliverables are transferred.
• For larger projects, milestone-based payments may be arranged as outlined in the project proposal.
• Late payments may result in project delays or suspension of services.

Intellectual Property

Upon full payment, you own all rights to the custom code, designs, and content created specifically for your project. xmpl retains the right to use general techniques, tools, and frameworks that are not unique to your project. We may showcase your project in our portfolio unless you request otherwise in writing.

Client Responsibilities

• Providing timely feedback, content, and approvals as needed during the project.
• Ensuring that all content and materials you provide are owned by you or properly licensed.
• Responding to communications within a reasonable timeframe to keep the project on schedule.

Warranties and Disclaimers

We warrant that our services will be performed in a professional and workmanlike manner. All deliverables include 30 days of post-launch support for bug fixes. Beyond this warranty period, additional support is available through optional maintenance plans. Our services are provided "as is" without additional warranties, express or implied.

Limitation of Liability

xmpl's total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific project in question. We are not liable for indirect, incidental, or consequential damages, including lost profits or business interruption.

Cancellation and Refunds

Either party may terminate a project with written notice. If you cancel after work has begun, payment is due for all work completed up to the cancellation date. Deposits are non-refundable once work has commenced, as they cover the initial planning and design phases.

Website Use

You may use this website for informational purposes and to engage our services. You agree not to misuse this website, attempt to gain unauthorized access, or use it in any way that could damage or impair its functionality.

Changes to These Terms

We reserve the right to update these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our website or services after changes are posted constitutes acceptance of the revised terms.
